Town of Warwick Selectboard September 2, 2014 Minutes Members present: Nick Arguimbau, Dawn Magi, Patricia Lemon (via Remote Participation, joined meeting at 6:03 p.m.) Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Firefighter Bill Lyman, Fire Chief Ron Gates, Planning Board Chair Ted Cady, Treasurer Beth Gilgun, Building Inspector Phil Delorey, Jon Calcari I. Call to Order Chair Arguimbau called the meeting to order at 6:01 pm in Town Hall. Bill Lyman was recording the meeting. II. Public Comment Fire Chief Ron Gates addressed the Selectboard by reading a letter dated September 2, 2014: "The Warwick Fire Department is in need of a pump which will allow us to fill our new tanker at 750 GPM. It is on the same idea as our 2 1/2 duce only the duce holds 750 gallons. The new tanker holds 2800 gallons. We have done our homework and found a pump for $5700.00; we have quotes for smaller pumps that range up to $13,000.00. It will take about a year to complete this project. The tanker can give us 2800 gallons now but will have to be refilled with another engine taking time and manpower that we just do not have. We also need a portable holding tank that can accommodate the 2800 gallons when off-loaded. This will cost $3000.00. In order to build and outfit the truck and put it in service with piping fittings will cost $12,300.00. Please keep in mind we were asking for a new truck that cost three hundred thousand dollars. The two trucks that we acquired from the state were free." Sincerely, Chief Ronald Gates The Chief said that he and Bill Lyman had done research trying to find the best quality equipment for the cheapest price. He noted that this was not in the Fire Department's FY 15 budget. Magi inquired about the availability of grants; the Chief replied that so far he and Lyman have been unable to identify any grants that would fund this type of project, but that they were still looking for the right funding source. Chief Gates said that he planned to ask to have an article placed on the September 22, 2014 Special Town Meeting warrant. He said that he had spoken to Finance Committee member, Rick Abbott, who wanted to try to meet before the STM. Lemon said that she needed more information before placing it on the warrant. There was a consensus of the Board to schedule a meeting at 5 p.m. on Monday, September 8th to finalize the STM warrant and have it printed and signed in time for the legal posting to be done prior to 7 p.m. that evening. Ted Cady suggested a dedicated device for remote participation, as it would make everyone more easily understood and heard properly in the meeting. Young said that he had researched such a device, and that the cost of what would be required was about $1,400.00. Lemon said that she expected to be back by or before the STM; Young said that the device would not get here before then anyway. III. Minutes Magi MOVED to approve the minutes of the August 18, 2014 meeting as printed. Arguimbau SECONDED. Motion CARRIED 3-0-0. IV. Presentations and Discussions 1. State Primary Election--Town Clerk Fratangelo explained that the Selectboard could appoint Constables for one day to be present at the polls as required by law. Also, there were supplemental election Worker appointments that she requested be voted by the Board. Magi MOVED to appoint Calvin Fellows and Rod Whipple as Constables for one time only for the State Primary Election on Tuesday, September 9, 2014. Arguimbau SECONDED. Motion CARRIED 3-0-0. Magi MOVED to appoint Regina Curtis, Andrea Woods and Sheryl Fontaine as Election Workers for a one-year term to expire on August 31, 2015. Lemon SECONDED. Motion CARRIED 3-0-0. 2. Special Town Meeting September 22 Warrant --Young said that he had spoken with Town Counsel and that the attorney's legal opinion was to strike proposed articles #3 and #4 from the STM warrant. Young said that once the Town Clerk in Northfield certified the override vote, two-thirds of the PVRSD member towns approved the school budget and it has therefore passed. Young said that documents from 1989 and MGL 71:16B were used to help to form Town Counsel's legal opinion that once the Annual Town Meeting dissolved, the vote cannot be reconsidered. Arguimbau MOVED to strike proposed articles #3 and #4 based on the information given. Lemon SECONDED. Motion CARRIED 3-0-0. Magi MOVED to add an article to the September 22nd Special Town Meeting warrant stating that the $12,300.00 referred to in Chief Gates' letter of today be approved. Lemon SECONDED. Motion CARRIED 3-0-0. 3. Announcement of DCR Proposed Acquisition of 90+ Acres in Warwick--Young said that DCR had notified the Town that they plan to acquire 90+ acres in the northwest corner of Warwick that is adjacent to contiguous property in Northfield. Young said that the Town receives more payment in lieu of taxes from the State than from privately held land in Chapter 61. At 6:30 p.m. Arguimbau announced the proposed acquisition by DCR of 90+ acres in the northwest corner of Warwick. This public announcement was required before Fratangelo signed the document as Town Clerk. Building Inspector -- Phil Delorey came before the Board at Arguimbau's request. The Selectboard Chair wanted the Building Inspector to conduct inspections in winter and summer looking for unpermitted structures and zoning violations of any kind and enforcing any noncompliance with zoning by-laws, and to report his finding to the Board. Delorey said that in the normal course of his duties he drives most roads in town every year, observing and pursuing any violations, and asked for clarification on how Arguimbau wanted this to be done. Delorey noted that there would be some roads that he had not driven on in the past year, and Arguimbau suggested that he check all roads missed within the past six (6) months. Delorey said that zoning violations are more obvious in winter due to the lack of foliage, and that he felt semi annual inspections would be redundant. He indicated that he was comfortable with doing this on a yearly basis in the winter months, and that he would take action on and report illegal structures and zoning violations to the Selectboard. Arguimbau mentioned a tree house and cabin that had been discovered awhile ago which were found to be unpermitted structures. Delorey said that these were now permitted, but that they were not on a town road and had to be reached by ATV. Arguimbau said that he wanted there to be a new policy that an inspection be done annually in winter. Lemon MOVED to add to the Building Inspector's job description that he conduct annual perusal of all properties throughout the Town looking for unpermitted structures and uses as well as zoning violations, and submit a yearly report to the Selectboard. Magi SECONDED. Motion CARRIED 3-0-0. Fratangelo read the motion aloud before the vote was taken. A discussion took place regarding the ZBA decision on the Wagon Wheel Campground. 5. Schedule Pole Hearing--Young said that Verizon had requested a pole hearing for a single pole at the intersection of Gale Road in Warwick and Main Street in Orange. He suggested September 29th at 6:30 p.m. Magi MOVED to conduct the Pole Hearing on Monday, September 29, 2014 at 6:30 p.m. Arguimbau SECONDED. Motion CARRIED 3-0-0. Execute WCS Roof Borrowing Documents--Treasurer Beth Gilgun told the Board that the $155,000.00 borrowing for the WCS roof project approved by Annual Town Meeting vote, would be done at an interest rate of 0.53%. Gilgun said that she had documents requiring the signatures of the two Board members present. Magi and Arguimbau signed the documents. Young had MassWorks contracts that required the Selectboard Chair's signature. Magi MOVED that Chair Arguimbau be authorized to sign the MassWorks contracts. Lemon SECONDED. Motion CARRIED 3-0-0. Arguimbau signed the necessary documents. Young and Lyman gave positive reports on the progress of the WCS roof project. 7. Selectboard Reports --Lemon had drafted a letter to Governor Deval Patrick stating the Town's opposition to the proposed gas pipeline. Lemon wanted a copy sent to all our representatives and said that she would post it to various discussion groups as well. Young noted some typographical errors that had to be corrected before the letter can be signed and sent. Arguimbau MOVED to authorize the Board Chair to sign the corrected letter. Magi SECONDED. Motion CARRIED 3-0-0. Arguimbau wanted to invite the PVRSD teachers here to conduct open and direct contract negotiations. Lemon said that she wanted Arguimbau to represent Warwick in the budget discussions with the Teachers Association, and that she would be sure that he had a way to get to any meetings. Lemon said that it was important for us to have our own representative rather than relying on one from Bernardston. Arguimbau agreed, and said that there was no need to invite the teachers union here after all. 8. Coordinator Report--Young said that he had nothing to add to his written report.
