Town of Warwick Selectboard September 17, 2012 Minutes Members present: Dawn Magi, Patricia Lemon, Nick Arguimbau Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Paul Daniello (Mt. Grace Land Conservation Trust), Jon Calcari I. Call to Order Chair Magi called the meeting to order at 6:00 pm in Town Hall. Public Comment None. Minutes Lemon MOVED to accept the corrected minutes of the September 4, 2012 meeting as printed. Magi SECONDED. Motion CARRIED 3-0-0. IV. Presentations and Discussions 1. Update on Proposed Broadband Contract Renewals--Young said that five days earlier, when he spoke with Eve Strother at DCR, was that the file is on that person's desk. Young credited Mary Jane Bacon of Senator Rosenberg's office with the idea of getting DCR to issue the permit to install the four additional devices on the tower, and deal with the contracts later. 2. WCS Sprinkler Code Compliance Work-- Young showed Board members the written order received from the State Fire Marshal. The Massachusetts Non-Criminal Fire Code Violation Notice form, ticket # F051-027171 described the violation as "failure to maintain a fire protection system" and ordered the Town "to have remaining sprinkler repairs corrected... by a licensed sprinkler contractor" by October 31, 2012. Young said that he had expected a more specific written order that included specific explanations for an order to update to a 2008 code. He noted that the sensors and alarms will be wired into the fire panel He also pointed out that the work has been ordered, and that no fine has been assessed by the Fire Marshal. Lemon MOVED to authorize David Young to have S&S complete the work as ordered. Arguimbau SECONDED. Motion CARRIED 3-0-0. Deputy Building Inspector Appointment -- Young said that Building Inspector Phil Delorey had requested that the Selectboard appoint an alternate Building Inspector, which would allow for issues to be handled promptly should they arise at a time when Delorey is unavailable. Young noted that the cost would be covered under the existing budget. Young recommended that the Board appoint Brian Gale, who is the Building Inspector for the Town of Orange, had previously served as Building Inspector in Warwick, and had agreed to serve if appointed. Lemon MOVED to appoint, with thanks, Brian Gale as Deputy Building Inspector with the understanding it has no additional budgetary implications. Arguimbau SECONDED. Motion CARRIED 3-0-0. 4. Manring and Jay Conservation Restriction Contracts-- Paul Daniello of the Mt. Grace Land Conservation Trust (MGLCT) spoke about the Conservation restrictions (CRs) for the Ralph Jay and Lynn Manring properties. Daniello said that both acquisitions are funded through the Massachusetts Forest Legacy Program. This agency will contract with the Town, transfer the funds to the Town, and the Town will in turn transfer the funds to the landowners. Daniello said that DCR has put together the contracts at the maximum amount of the appraised valuation of the two CRs, which is $295,000.00. Daniello said that the MGLCT would like to see the Selectboard vote to sign the contracts to move the process along. He explained that what he had to present to the Board were a standard Massachusetts contract form, a DCR and Massachusetts contract with additional terms and conditions, and the standard authorized signatories form. Town Coordinator Young suggesting naming him and Board Chair Magi as signatories would facilitate future action. Lemon MOVED to approve the contracts and authorize the Chairman to sign on the Board's behalf. Arguimbau SECONDED. Motion CARRIED 3-0-0. Daniello said that the Conservation Commission had agreed to conduct the requisite annual monitoring of the land. A letter will be sent from the Con Comm to the Forest Legacy Program Director reflecting this decision. Daniello noted that several Con Comm members have received training on annual monitoring from MGLCT, and that additional training will be provided when necessary. He also noted that someone from MGLCT will accompany Con Comm members when they visit the properties to conduct the annual monitoring. 5. Town Sand Pit--Young said that Highway Superintendent Tim Kilhart had sent a letter to the Board saying that the material in the sand pit is not used by the Highway Department due to its unsuitability as backfill and road sand. Lemon and Magi both said that they saw no reason to take action, but Arguimbau thought that the sand pit should be closed to outside contractors. Young suggested that he accompany Arguimbau to view the site and not merely rely upon the photographs handed out at the beginning of the discussion. Arguimbau agreed. 6. Selectboard Reports--.Arguimbau said that he had seen Ken Hubbard on Route 78 with his team of horses and that the warning signs were not yet up. Young said that the signs may still be on order. Magi brought up the Board's participation in Bernardston's 250th anniversary parade on Saturday, September 22nd. Young said that they will be riding in Brian Hubbard's wagon which will be drawn by Ken Hubbard's horses. Magi and Young will create signage for the wagon. Magi said that she had contacted five bands for the 250th anniversary ball. The only response she has received so far is from a Contra band. Magi also wanted letters of congratulations sent to the Junior Firefighters muster team for their victory at the Franklin County Fair, as well as to Alyssa and Megan Weld for their virtual sweep of the sheep competition at the Franklin County Fair. Coordinator Report-- Arguimbau said that he had looked at the map on the Department of Public Health website to check on the EEE and West Nile virus status for Warwick. He said that we were in a high danger area. Young showed the Board a medal struck for Hartford's 235th anniversary. Gregori Brodski wants to have a medal made for each resident to commemorate our 250th anniversary next year. Young said that the Recreation Committee has a vacancy, which he will advertise. He said that he prefers the new member focus on adult fitness and recreation. Young noted that twice weekly Zumba classes will be held at Town Hall on Tuesday and Sunday mornings, in addition to the Tai Chi classes on Tuesday mornings. Young said that Jim McCrae will host a monthly open mike at Town Hall on the last Saturday of each month, beginning on September 29th. This was originally to be a part of the 250th anniversary celebrations, but this event is being started early. Young also said that he will be seeking input from residents on the hazard mitigation plan. New and Other Business--There was no new or other business.
