Town of Warwick Selectboard August 22, 2011 Minutes Members present: Patricia Lemon, Nick Arguimbau Member Absent: Dawn Magi Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Paul Daniello (Mt. Grace Land Conservation Trust), Open Space Committee and Conservation Commission member Mary Williamson, Joe and Kristy Dalfausse, Jon Calcari, Jared Robinson (Athol Daily News) I. Call to Order Acting Chair Lemon called the meeting to order at 6:00 pm in Town Hall. Public Comment None. Minutes Lemon MOVED to accept the minutes of August 8, 2011 as printed. Arguimbau SECONDED. Motion carried by a vote of 2-0-0. IV. Presentations and Discussions 1. Field Driver Appointment -- Lemon said that Amy Person is looking forward to being the new Field Driver, and pointed out that Person has the proper equipment to transport large farm animals and a suitable place to board them if necessary. She noted that Police Chief David Shoemaker had done a background check and approved Person's appointment. Lemon explained the duties of the Field Driver, and instructed Animal Control Officer Rosa Fratangelo Calcari to meet with Person to discuss a fee schedule to be brought before the Board. Lemon MOVED to appoint Amy Person Field Driver for the Town. Arguimbau SECONDED. Motion carried by a vote of 2-0-0. 2. Temporary Road Closing -- Young said that each year Athol Road is closed for Old Home Days. Arguimbau MOVED to temporarily close Athol Road in front of Town Hall for Old Home days Saturday, August 27th. Lemon SECONDED. Motion carried by a vote of 2-0-0. Potential Conservation Restriction -- Because Lemon is an abutter to the land and therefore has a financial interest in the issue to be discussed, she recused herself from the proceedings and turned the Chair over to Arguimbau. Lemon said that she would listen to the discussion, but not participate. Paul Daniello of the Mt. Grace Land Conservation Trust spoke about the termination of the Herman Wirth conservation project and a proposed substitute project involving land owned by Ralph Jay. Daniello handed out maps for viewing during the discussion. Daniello pointed out that the forest resources on the land will be managed as a working forest as a condition of the Forest legacy Program. He said that the CR meets the goals of the Town's Open Space and Recreation Plan. He noted that he had met with the Conservation Commission and that the Con Comm is agreeable to the CR and wanted to explore the possibility of a public trail on the land. Arguimbau asked if there would be a provision for preservation of the cemetery within the CR; Daniello said that this would be included in the CR. Daniello hoped for a Board vote in support of the pursuit of an acceptable CR. However, due to Magi's absence and Lemon's inability to participate due to the conflict of interest, Daniello will attend the next Selectboard meeting to revisit the issue. Young said that he would urge the Board to favor the proposal, and Arguimbau expressed his support as well. Mary Williamson said that the Open Space Committee supports the project and will send a formal memorandum to the Board. Arguimbau gave the Chair back to Lemon. 4. Special Town Meeting -- Young handed out a draft warrant for a Special Town Meeting to be held in September. He said that the available dates were the 19th or the 26th, and noted that the Moderator preferred the 26th for the meeting date. Lemon MOVED to set the Special Town Meeting date as September 26, 2011 at 7 pm in Town Hall. Arguimbau SECONDED. Motion carried by a vote of 2-0-0. Arguimbau MOVED to open the Special Town Meeting warrant today and close it on August 29, 2011. Lemon SECONDED. Motion carried by a vote of 2-0-0. Lemon mentioned the recent resignation of Jeffrey Joyce from the Cemetery Commission, and requested that David Young write Joyce a note thanking him for his service to the Town. Update on Whittier Nuisance Dog Order Compliance -- Animal Control Officer Rosa Fratangelo Calcari reported that Kyle Whittier had erected a kennel for his dog "Dozer". She noted that he did not comply with the initial order, which required the kennel be in place by August 13th. The top of the kennel was not covered, nor was there a doghouse inside, but the structure was in place. Young said that if the dog is found loose again the Board will call for another hearing and can vote to order the dog be removed from Town. Selectboard Reports -- Arguimbau revisited the review and accept agenda item that used to appear on every agenda prior to last meeting's vote to end the practice. Young explained that any Board member can contact him to add agenda items up to 3 pm on the Thursday prior to the next meeting. Selectboard meetings are legally posted by Young at 5 pm the Thursday before the meeting. Lemon promised to send daily Email reminders to the other Board members about adding items to the agenda. Lemon spoke about the MassWorks Infrastructure Program as a potential source of grant funds to help build the proposed new Public Safety Building. She noted that the Buildings and Energy Committee has been looking into grant funding, and has identified one source. However, that source would require the Town to accept the Stretch Code. Lemon said that she had been in touch with an administrative assistant in Senator Brewer's office, who will research the possibility of other grant funding sources. Lemon said that she will be out of town from August 29th to September 9th, but will be available by Email. 7. Coordinator Report-- Young gave information on the Association of Town Finance Committees annual meeting on October 15th. Selectboard members are invited to attend. 8. New and Other Business-- None.
