Town of Warwick Selectboard July 11, 2011 Minutes Members present: Dawn Magi, Patricia Lemon, Nick Arguimbau Others present: Town Coordinator David Young, Building Inspector Phil Delorey, Kristy DelFausse. I. Call to Order Chair Magi called the meeting to order at 6:00 p.m. in Town Hall. Public Comment - None. III. Minutes Lemon MOVED to approve the minutes of the June 27, 2011, Selectboard meeting, as printed. Magi SECONDED. Motion carried by a vote of 2-0-0. Lemon MOVED to approve the minutes of June 27 2011, Municipal Light Board Supervisors' Meeting as printed. Magi SECONDED. Motion carried by a vote of 2-0-0. Arguimbau joined the meeting at 6:05 pm. IV. Presentations and Discussions 1. Hiring of WCS janitor as temporary part-time employee--Young explained that again this summer the janitor is on shortened hours at the school and is available to work as a Town employee doing painting and other capital improvement at WCS at his $13/hour rate. Lemon MOVED to approve hiring Nathan Towne as a temporary, part-time town employee for July and August. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. 2. Date of Wendell Road Pole Hearing--Verizon has requested permission to site four new utility poles on Wendell Road near Northfield Road. Lemon MOVED that August 8, 2011, at 7 pm be set as the date of the Pole Hearing. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. 3. Building Inspector Phil Delorey--gave an update on the ongoing enforcement activities at places where people are living / camping and not in zoning compliance. He noted that two have Conservation Commission issues that need to be addressed. These are the Dyer and Gallagher cases where the Selectboard was assured that special permit applications would be issued within 30 days of the late May meeting where this was discussed with landowner's counsel. David Young clarified that this week he asked counsel to submit the special permit applications now and not to wait for resolution of the notice of intent (NOI) to Conservation Commission. Delorey noted that any structures affixed to the ground require a building permit. Arguimbau questioned why the Board of Health was not leading the enforcement action. Young explained that the state health inspector had advised that we first deal with zoning, conservation and building code matters. Young noted that the BoH would not permit anything not in compliance with other by-laws. Delorey made the point that a certificate of occupancy won't be issued until everything is in compliance. Lemon MOVED to renew approval of the building department's fee schedule and specifically that all construction will pay a double building fee if started before issuance of building permit. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. The Housing Court case against Jane Severance was discussed. Delorey said that progress has been made on carpentry, windows, and removal of a vehicle stored in the building. The owners are under court order not to live in the premises until a certificate of occupancy is issued. In order for that to happen the owner-built plumbing and electrical work must be inspected. The inspectors require a licensed tradesman to check the work and order the inspection. The owners seem unable or unwilling to do this. The next hearing is September 16. Town counsel recently sent the owners a letter saying that the Town is prepared to enforce the building code up to and including demolition of the structure if work is not completed by the hearing date. The Selectboard reviewed their options which ranged from doing nothing to rigorous enforcement. Young agreed to pursue the option of CDBG housing rehab assistance and Selectboard member Arguimbau agreed to develop a written solution for the matter to take to housing court hearing for consideration. 4. Selectboard Reports--There were no Selectboard reports. 5. Coordinator Report--There were no questions from the board regarding Young's written report. 6. New and Other Business-- Kristy DelFausse asked what can be done about a neighbor's unsightly travel trailer that she thought was being used as a dressing room. Young explained that it falls under motor vehicles and that everybody gets one and no more than one unregistered motor vehicle under our zoning by-law. The board asked Young to give notice to residents, via the newsletter, that we will be taking uniform enforcement action on the junk car by-law. V.
