Town of Warwick Selectboard June 27, 2011 Minutes Members present: Dawn Magi, Patricia Lemon, Nick Arguimbau Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Police Chief David Shoemaker, Police Officer Bruce Kilhart, Personnel Committee member George Day, Board of Health member Helen Whipple, Veterans Agent Jim Erviti, Open Space Committee Chair and Conservation Commission member Mary Williamson, Broadband Committee member and WiredWest Representative Reva Reck, Jon Calcari, Paula Robinson (Athol Daily News) I. Call to Order Chair Magi called the meeting to order at 6:00 pm in Town Hall. Public Comment Bruce Kilhart inquired about building permits being available online. Young said that the FRCOG allows for building permits to be submitted online. He explained that Warwick's procedure involves either providing a paper copy of the building permit application to, or downloading it from the Warwick website and Emailing it to, the Town Coordinator. Young said that he then forwards the Emailed applications, or scans the paper copies and Emails them to, the Building Inspector. Lemon said that she will look into identifying a program that would allow Warwick to have an online building permit application process. Athol Daily News reporter Paula Robinson noted that the Town Hall Dining Room looked "absolutely beautiful". Magi called for a moment of silence to remember Les Goodman, who passed away June 19th. She noted his invaluable service to Warwick, and said that this is a great loss to the Town. III. Minutes Lemon MOVED to approve the minutes of June 13, 2011, as printed. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. IV. Presentations and Discussions 1. Re-appointment of Highway Superintendent Tim Kilhart -- Young explained that, according to Town Clerk Jeannette Fellows, Tim Kilhart's appointment as Highway Superintendent expires June 30th. Lemon MOVED to reappoint Tim Kilhart the Highway Superintendent for a three-year term beginning July 1, 2011 and ending June 30, 2014. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. 2. George Day -- Personnel Committee member George Day had given each Board member a printed copy of modifications made to the Warwick Personnel Policy and recommended that the Selectboard vote to accept these changes. Previously, the Selectboard had asked the personnel Committee to review the policy and make recommendations. Arguimbau MOVED to accept the modifications as written. Lemon SECONDED. Motion carried by a vote of 3-0-0. Modifications are as follows: VI. Employment Practices F. Grievance Procedure Step 1 Within thirty calendar days of the incident or the action causing the problem, the complaint will be presented in writing to the employee and discussed with the immediate supervisor, who in some cases will be the department head. After this meeting the supervisor will provide to the employee, in writing, a brief summary of the problem and a suggested resolution to it within five calendar days following the meeting. If the immediate supervisor is the department head, the next step in this procedure is Step 3; otherwise Step 2 applies. X Benefits Insert after first sentence An employee is considered permanent full-time or permanent part-time after successfully completing the review period as outlined in Section V:D and is entitled to all fringe benefits outlined in this section (sub-sections a-i) if the review period is completed during the current fiscal year. 3. Police Chief Shoemaker -- Chief Shoemaker had previously provided the draft of a new Police mutual aid agreement between Warwick and the towns of Erving and Northfield. He provided copies of the documents for Board Chair Dawn Magi's signature. Lemon MOVED to approve the mutual aid agreement as printed. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. Chief Shoemaker requested that the Board vote to promote full-time Police Officer William Fisher to the position of Sergeant. The Chief noted that Fisher had completed the 80-hour Sergeant's course, and that he is also a certified EMT and First Responder who is qualified to teach First Aid. Lemon MOVED that William Fisher be promoted to the rank of Sergeant in the Warwick Police Department. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. 4. Approve FY 12 Pay Raises -- Young explained that the Board of Health in its capacity as Board of Commissioners of the Transfer Station Enterprise Fund, approved to increase the hourly pay rate of the Transfer Station Attendant from $10 to $12 per hour. Board of Health member Helen Whipple spoke in favor of the pay raise, noting that this is still well under the average pay for transfer station attendants in the western part of the state. Young also recommended the pay raise. Lemon MOVED to increase the Transfer Station Attendant pay rate to $12.00 per hour beginning July 1, 2011. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. Young said that when the Highway Department was reorganized last year, the position of machine operator was eliminated. There are currently three truck driver/laborer positions. Young explained that under the FY 12 budget, 81 cents per hour was available. He recommended raises for the Highway Superintendent and the three truck driver/laborers of 20 cents per hour. Arguimbau MOVED to approve a 20 cents per hour raise to the four Highway employees as printed in David Young's Town Coordinator Report. Lemon SECONDED. Motion carried by a vote of 3-0-0. J. Calcari commented on the excellent job done in grading Old Winchester Road this Spring. Lemon suggested sending a letter of thanks to Calvin Fellows for his considerable assistance in providing his instruction and expertise to the highway crew in road grading. 5. Selectboard Reports -- Lemon said that she was thinking of the possibility of having people be able to make donations to various Town accounts or pay taxes online using a credit card. It was determined that the final decision rests with the Treasurer, and he is bonded and responsible for all the Town's funds and online payments could generate the need for increased working hours. Young said that the Town must receive the full payment due, and that the credit card company would add on fees to the payee. There was a consensus of the Board that Treasurer Terry Kemerer should be invited to a future meeting to discuss the issue. 6. Coordinator Report -- Young asked the Board if there were any questions on his printed report. Lemon said that she found the report to be "admirable complete". Lemon inquired about Bill Lyman's bid to put a new metal roof over the Highway Department facilities. She also asked about the situation with the residents who have retained an attorney to pursue a resolution to the situation involving the collection of water on their property from a town culvert. Young said that he advised the property owners to engage the services of an environmental scientist to provide clearer insight and greater expertise with respect to their options. The Conservation Commission issued a stop work order to the residents, who were attempting to get rid of the excess water. 7. H.3438 so-called Public Lands Preservation Act -- Mary Williamson gave a brief report of her research into House Bill 3438. She said that she found the bill to be practical and quite well worked through. Williamson said that this bill affects only lands purchased with public funds, such as the Hockanum Hill Project. She explained that any land the Town owns that was acquired by other means, including the town forests, will not be affected. Arguimbau said that the Audubon Society was really pushing for this bill; Williamson concurred. She added that the Massachusetts land Trust Alliance also considered the bill to be a priority. Arguimbau MOVED the Board recommend passage of H.3438 and asks that Mary Williamson draft a letter to out members of the Legislature, which Young will print and send. Lemon SECONDED. Motion carried by a vote of 3-0-0. 8. New and Other Business -- Lemon MOVED to appoint Martha Kitchen to the Cultural Council for a term commencing July 1, 2011 and ending June 30, 2014. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. Young asked the Board to append the FY 12 Appointment list to include Tim Kilhart's appointment as Highway Superintendent and Martha Kitchen's appointment to the Cultural Council. Arguimbau MOVED to add Tim Kilhart and Martha Kitchen to the FY 12 Appointment list. Lemon SECONDED. Motion carried by a vote of 3-0-0. Young spoke about the open house held on Saturday, June 25 to celebrate the life of Les Goodman. Young suggested that a gathering in Les Goodman's memory be scheduled at some time in the future at Town Hall. Mr. Goodman served on the Finance, Buildings and Energy, and Broadband Committees, and was also a Broadband installer. V. Adjournment At 7:00 pm, Lemon MOVED to adjourn the meeting. Magi SECONDED.
