Town of Warwick Selectboard June 14, 2010 Minutes Members present: Dawn Magi, Patricia Lemon, Nick Arguimbau (arrived at 6:07 pm) Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Janice Starmer, Elias Humphries, Claudia Lewis, Jon Calcari, Nancy Kilhart (arrived at 6:32pm), Jared Robinson (Athol Daily News, arrived at 6:17 pm) I. Call to Order Vice Chair Lemon called the meeting to order at 6:03 p.m. in the Town Hall. . II. Public Comment Elias Humphries spoke about a recent negative experience he had involving a Warwick police officer. Humphries stated that the officer had followed him through three towns without identifying himself. Janice Starmer echoed the concerns expressed by her son. Lemon thanked them for bringing this to the Board's attention, and suggested that they also speak directly to Police Chief Brian Peters. Arguimbau wanted a written inquiry from the Selectboard to the Police Chief regarding the policy of the Police Department on the use of personal vehicles for police work. Arguimbau added an item to the agenda regarding the Historical Society Building. III. Minutes Magi MOVED to approve the minutes of June 7, 2010 as written. Lemon SECONDED. Motion carried by a vote of 3-0-0. IV. Presentations and Discussions 1. WCS Sprinkler System -- Young recommended that the Board approve the Simplex Grinnell proposal, award the contract and sign the agreement. Special Town Meeting vote appropriated the necessary funds, and Town Counsel has reviewed Simplex Grinnell's documents. Young noted that the price has decreased approximately $4,000.00, and also pointed out that Fire Chief Gunnar Lambert had recently written another letter reinforcing the order to repair, so time is of the essence. The engineering portion of the work will begin as soon as the documents are signed. Arguimbau said "because the Board finds that with regard to the sprinkler system there is an imminent danger to persons and property and accordingly we cannot do anything that will jeopardize the completion of the project this year, and therefore" MOVED that for the reasons stated the Town accept Simplex Grinnell sprinkler system proposal in the amount of $192,000.00 and authorize the Chairman of the Selectboard to sign the proposal and execute a contract on behalf of the town. Lemon SECONDED. Motion carried by a vote of 3-0-0. 2. Review of U.S. Census Map of Warwick-- Lemon said that she had received a group of maps from the U.S. Census Bureau and wanted the maps reviewed for any errors. She suggested everyone take a look at the maps after this meeting is adjourned. 3. Roadside Wood Policy -- Young recommended that the Board look at changing the long standing policy regarding roadside wood cut on Town property. The Accountant has questioned the practice of allowing abutters or the general public taking the wood, as this may be improper handling of Town assets. Young recommended all wood be removed by the Highway crew and stacked at the Highway facility or Transfer Station. A vote at a future town meeting could allow the wood to become the property of the Poor Fund. Lemon MOVED to adopt a policy that merchantable firewood removed from the roadside by the Highway department or utilities from Town property be hauled and stacked at a concentration area under Town control for disposition or for sale as surplus property. Magi SECONDED. Arguimbau made a friendly amendment that after "area", the words "chosen at the discretion of the Town Coordinator" be added. Lemon ACCEPTED the amendment. Motion carried by a vote of 3-0-0. 4. Annual Appointments -- The Board was presented with a list of appointments for terms currently due to expire June 30, 2010. The last page of the list was a letter to the Board from Open Space Committee Chair Mary Williamson requesting appointments to the Moore's Pond Beach Committee. This will be considered an advisory committee until a Town meeting vote establishes it as a permanent entity. Lemon MOVED to establish an Advisory Committee on Moore's Pond Beach to work with the Open Space Committee on issues regarding Moore's Pond Beach. Magi SECONDED. Motion carried by a vote of 3-0-0. Magi MOVED to appoint the individuals on the FY 2011 Appointment List for terms as written. Lemon SECONDED. Motion carried by a vote of 3-0-0. FY 2011 Appointment List is included at the end of the Minutes. 5. Historical Society Building -- Arguimbau wanted to know if anything can be done to speed up the process of addressing and correcting moisture and conservancy issues in the building which arose during an inventory of the first floor contents. Young explained that the building was conveyed from the Town to the Historical Society by a Town meeting vote in the 1990's. Most likely its contents also belong to the Warwick Historical Society, Inc. He said that by a Town meeting vote the Town may be able to dedicate funds for preservation and betterment of the building; he will confer with Town Counsel. Arguimbau said that the building needed insulation, heating and air conditioning to maintain a constant temperature of 60 degrees. He said a professional needs to be brought in to ascertain the condition of the materials and evaluate the necessary steps to preserve them, and wanted the Selectboard request that the Historical Society do all in its power to get the process underway. Magi suggested looking to possible sources for grant funding. Young noted that due to procurement laws, Town involvement is likely to prove more costly than if the Historical Society approaches the project with its non-profit status. Magi MOVED to appoint Patricia Lemon to the Historical Commission. Motion then WITHDRAWN pending further thought on the matter. Young, Lemon and Arguimbau will meet in their individual capacities with the Historical Society to begin discussions on the issues of conservancy and eradication of excessive moisture. 6. Selectboard Reports-- Magi said the recent Massachusetts Municipal Association meeting was excellent and highly informative. Lemon wanted to have the Board revisit the green community issue, and will invite a representative from the Department of Energy Resources. Arguimbau said that he attended a training session on the new Open Meeting and conflict of interest laws and was told that an extension of compliance to November 1st had not yet passed the Legislature; he urged the Board to comply with all new regulations by July 1st rather than waiting for the proposed extended deadline of November 1st. Young said that the new rules have essentially been followed since he attended a similar training session a few months ago. 7. Town Coordinator -- Young covered a range of topics from his written report. The unused Town Hall chimney has been taken down, carpentry work is underway, and the roofing bid will be advertised when carpentry work is finished. With appreciation, Young has given the go ahead to the Women's Guild for its offer to have the Town Hall dining hall painted. A cost analysis for a single-phase electric powered paper compactor for the transfer station was discussed, followed by the mention of a meeting Young will be having soon regarding the potential to site a Solar Farm on the capped landfill. Young announced that Highway Superintendent Tim Kilhart was appointed to the Tri County Superintendent's executive committee, and that the Hockanum Road crumb rubber project has been completed. Young noted that he will be out of the office on June 17th and 23rd for non-Town business. 8. New and Other Business -- None. V. Adjournment Lemon MOVED to adjourn the meeting at 7:53 pm.
