Town of Warwick Selectboard June 13, 2011 Minutes Members present: Dawn Magi, Patricia Lemon, Nick Arguimbau Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Jon Calcari, Jared Robinson (Athol Daily News) I. Call to Order Chair Magi called the meeting to order at 6:01pm in Town Hall. Magi inquired about the postponement of the zoning and building code enforcement agenda item as it pertained to the discussion from the May 31, 2011 meeting. Young explained that Building Inspector Phil Delorey had a scheduling conflict and was unable to attend this meeting. Young said that a meeting needs to be scheduled with Delorey during the day on a Friday. Lemon noted that the deadline for submitting comments, questions and concerns to the DCR about the proposed Forest Zones is August 26, 2011. Lemon handed out a map of Warwick's proposed forest zones, and said that she will be providing more detailed maps in the near future. Lemon MOVED to accept the agenda for this meeting. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. Public Comment None. III. Minutes Lemon MOVED to approve the minutes of May 31, 2011, as printed. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. IV. Presentations and Discussions 1. Zoning and Building Code Enforcement -- Young spoke about an ongoing issue with a resident who has failed to comply with the building code. He read aloud a draft letter designed to initiate compliance by the resident to be sent on the Board's behalf. Selectboard members suggested various changes. He also suggested that if such a permit is issued, it would be helpful if the ZBA were to require that the permit be registered as part of the deed to protect potential buyers and the town. Lemon MOVED to accept David Young's recommendations, as amended, and to instruct him to carry out the measures necessary to follow through. Magi SECONDED. Motion carried by a vote of 3-0-0. Young said that the State Building Code requires a building permit for all structures over 120 square feet. He also said that a special permit must be obtained from the ZBA to reside in a temporary facility more than fourteen days per year. A health code variance is also required. He also suggested that if such a permit is issued, it would be helpful if the ZBA were to require that the permit be registered as part of the deed to protect potential buyers and the town. 2. Forming Warwick Municipal Lighting Company -- Young explained that we need to name our newly formed lighting company, and that the Selectboard, as the Town's governing body, must vote on a name. He said that Wired West Representative Reva Reck had suggested Wired Warwick. Wired West is asking for the appointment of a manager/delegate and an alternate; Young suggested a three-year term of appointment for these positions. On the FY 12 Appointment list, which appears later on the agenda for this meeting, Reva Reck is named as the manager/delegate, and Patricia Lemon the alternate. Lemon MOVED to name our municipal lighting company Wired Warwick. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. 3. DCR Forest Zones -- Lemon said that she attended a recent workshop at Frontier Regional High School in South Deerfield regarding the proposed DCR Forest Zones. She later met with Ted Cady and they agreed that she will take the lead in securing good maps as part of the process of assembling feedback for the DCR and scheduling a joint meeting of the Selectboard, Planning Board, Open Space Committee, Conservation Committee, Town Forest Committee and the Tree Warden, once the maps are available as prints and digital documents, to review all pertinent information and to compile comments to send on to the DCR.. Lemon said that Cady had suggested a Wednesday evening well before the August 26 deadline for submissions. The Board gave Young the tentative dates of July 13 and August 8 for him to use in coordinating schedules and setting up the meeting. 4. End-of- Fiscal Year Transfers -- Young explained that Massachusetts law allows for funds to be moved within a department during the last month of a fiscal year. Highway Superintendent Tim Kilhart has requested a transfer of $1,780.00 from the wage line item to the expense line item to cover the cost of repairs to the alarm system, which was damaged by lightning during a recent storm. Young said that a vote of both the Selectboard and the Finance Committee is required to approve the transfer. Lemon MOVED to approve the transfer of $1,780.00 from the wage line to the expense line of the Highway Department budget. Arguimbau SECONDED. Motion carried by a vote of 3-0-0. 5. FY 2012 Appointments -- Some corrections of appointment dates and the addition of names inadvertently left off the list submitted by Fratangelo Calcari and Young were made. Magi MOVED to approve the list of FY 12 appointments with the corrections. Lemon SECONDED. Motion carried by a vote of 3-0-0. 6. H.3438 So-Called Public Lands Preservation Act -- Young said that he had contacted Representative Denise Andrews because there are some concerns about this bill; he will speak with her at some point after this meeting. Lemon said that she concurred with Ted Cady, that someone else will carry this issue. Arguimbau handed out a memo on the bill, and expressed his support for it. He said that Open Space Committee Chair Mary Williamson also supports this bill, and could report to the Board about the position of the land trusts on it. She was unable to attend the present meeting. Arguimbau MOVED that the Board support H.3438 and send a letter to our legislators asking them to support the bill and not oppose it, or to wait until Mary Williamson can attend a meeting to report on this issue. Lemon SECONDED. Both Lemon and Magi said that they preferred to wait for Williamson's input. Motion TABLED by Magi. Motion to table the issue carried by a vote of 3-0-0. 7. Selectboard Reports -- Lemon said that she wanted to ask Senator Brewer and Representative Andrews to support H.2660, a bill that providing financial support for public transportation in Central and Western Massachusetts. Lemon brought Town of Warwick note cards on which the Board could write to Senator Brewer and tell him that we want to remain in his district when the redistricting happens next year. Lemon said that he understands the issues that face Warwick; Magi concurred. Young pointed out that Warwick will be well served by either Brewer or Rosenberg. Coordinator Report -- Magi noted that Young had provided a very thorough report. 9. New and Other Business -- Magi said that evaluations of Town Coordinator David Young and Highway Superintendent Tim Kilhart are long overdue. Young said that he will put together an evaluation tool that can be agreed upon by the Board members. Young said that evaluations should serve as a roadmap to further improvement. Lemon offered to email copies of Young's job description and an evaluation form for their review and amendment; both accepted. V. Adjournment At 7:07 pm, Magi MOVED to adjourn the meeting.
