Town of Warwick Selectboard May 3, 2010 Minutes Members present: Rick Abbott, Nick Arguimbau, Patricia Lemon Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Open Space Committee and Conservation Committee member Mary Williamson, Moderator Al Mexcur, Paula Robinson (Athol Daily News) I. Call to Order Chair Arguimbau called the meeting to order at 6:04 p.m. in the Town Hall. Arguimbau added an agenda item regarding Moore's Pond beach. II. Minutes Lemon MOVED to approve the minutes of both the Vegetation hearing and Selectboard meeting held on April 20, 2010 as printed. Abbott SECONDED. Motion carried by a vote of 3-0-0. III. Presentations/Discussions 1. Review Annual Town Meeting Speaking Assignments--Young suggested alternating the reading of warrant articles. He also explained that Articles 11 and 15 would be taken out of order and presented prior to the Omnibus Budget (Article 5). Recognition of residents who died since last year's Town meeting will be read by Chair Arguimbau. Young said he will give special recognition to Ed Lemon for his work on the Warwick website, Albert "Buster" Alden for his decades of service to the Town on the Finance and Conservation Committees and the Planning Board, and Al Mexcur for his sixteen years as Moderator. 2. Resolution on Moore's Pond Beach--Young said that he was looking for a resolution from the Board in accordance with the provisions of article 8 of the purchase-and-sale agreement between the town and owner (and former resident)Neil Chadwick for the Moore's Pond beach property. Williamson spoke to the Board about article 8, which assures Chadwick and his family and guests access via the beach in recognition of his having allowed residents free access for the past 23 years. She said that Chadwick wants something in writing from the Town that will be noted in the minutes of this meeting. Lemon MOVED in recognition of the Seller's generosity in allowing residents of the Town of Warwick to use the Seller's beach over more than two decades, the Buyer shall request that the Selectmen of the Town of Warwick adopt a resolution, to be included in their minutes, stating that the family and guests of Neil E. Chadwick, and the family and guests of the immediate next purchaser of the remaining real estate of the Selah Realty Trust (about four acres of land with buildings on Wilson Road) will continue to have a right of access for swimming at the beach, subject to all town and state rules, regulations and ordinances that apply to other users of the beach. The term "guests" is intended to include all invited guests, even if from out of town. Abbott SECONDED. Motion carried by a vote of 3-0-0. 3. Hockanum Road Vegetation--the Board discussed Highway Superintendent Tim Kilhart's draft letter, which will be used as a paradigm for agreements between the Town and property owners. This will apply to all cutting on roads under shade tree and scenic by-law regulations. Lemon MOVED that the sentence which begins the second paragraph of the letter be amended to read "The following areas are the agreed upon cutting between the Town of Warwick and the Property Owner. (Attach diagrams and/or photographs specifying the work to be done.)" Abbott SECONDED. Motion carried by a vote of 3-0-0. 4. Report on WCS Sprinkler Bids--Young said that two proposals have been received. Copies of both proposals have been given to Jim Toth from the Buildings and Energy Committee, Selectman Rick Abbott and Finance Committee member Les Goodman for review and evaluation of the technical aspects. One company proposes to replace most of the failed portion of the system with a new type of pipe, while the other firm proposes to renovate the current system. Funding for this project is the subject of Article 18 of the ATM warrant. 5. New and Other Business--Al Mexcur arrived to discuss the ATM with the Board. It was agreed that Rick Abbott would lead the Pledge of Allegiance; Nick Arguimbau would remember the deceased citizens; and the reading of specific warrant articles was assigned to each Board member. Mexcur praised Young for his work on the ATM warrant. IV. Public Comment--Robinson inquired about the totem on Town Hall Lawn. Abbott explained that the Transition Towns initiating group placed it there to raise awareness of the impending decrease in the availability of oil, and the increased need for local sustainability and self-sufficiency. Calcari had to leave the stage at 6:52 pm, as she had been occupying the seat reserved for the Town Clerk for the Annual Town Meeting. At 7 p.m. the Selectboard meeting was suspended in order to convene the ATM. V. Adjournment After the Annual Town Meeting was closed at 9:50 pm, Moderator Al Mexcur turned over the gavel given to him by his predecessor Helen Whipple, and a handbook on parliamentary procedure. After sixteen years, Mexcur chose not to seek re-election. Lemon left the stage. Abbott MOVED to adjourn the meeting at 9:58 pm. Arguimbau SECONDED. Motion carried by a vote of 2-0-0.
