Regular Meeting Minutes - Warwick Selectboard April 2, 2015

Members present: Dawn Magi, chair; Nicholas Arguimbau Staff present:
David Young, town coordinator

Dawn Magi called the meeting to order at 2:00 p.m. Thursday April 2,
2015 at Warwick Town Hall boardroom

The first order of business was to consider a response to the allegation
of an Open Meeting Law (OML) violation filed with the board at the
previous meeting by Mr. Ruggiero. Town coordinator drafted a response
which says there is no violation because no one other than members of a
public body has a right to speak. Town counsel concurs with the draft
response and notes that the board needs to act within ten days and copy
the AG office.

On a motion by Nick, seconded by Dawn, the board voted to sign the
response which says "There is and was no violation because the Open
Meeting Law (OML) does not give anyone who is not a member of the board
the right to speak."

There being no other agendized business for open session, on a motion by
Nick, seconded by Dawn the board voted to go into executive session for
the purpose of discussing pending legal action, consideration of a
negotiated settlement, execution of release and gave notice that the
body does not intend to reconvene after executive session except to
adjourn. Roll call vote: Arguimbau, aye; Magi aye

The board went into executive session at 2:06 pm and came out of
executive session at 2:14 p.m. and immediately adjourned
