Town of Warwick Selectboard March 7, 2011 Minutes Members present: Patricia Lemon, Nick Arguimbau Members Absent: Dawn Magi Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Jon Calcari, Jared Robinson (Athol Daily News) I. Call to Order Chair Arguimbau called the meeting to order at 6:02 pm in Town Hall. Arguimbau said that, due the unavoidable absence of Dawn Magi, all agenda items other than the snow and ice deficit authorization and the MGL 268A:20D conflict of interest would be postponed until the March 21 meeting. Public Comment None. III. Minutes Action on the minutes of February 22, 2011, was postponed until the next meeting. IV. Presentations and Discussions 1. National Flood Insurance Resolution -- Discussion of this issue was postponed until the next meeting. 2. Chapter 268A Section 20D Conflict of Interest Exemptions -- Young presented the Board with the Disclosure of Financial Interest by Special Municipal Employee and Approval of Exemption form as required by MGL 268A:20(c) and 20(d). The form was filled out for Police Officer Bruce Kilhart in the event that a late March snowstorm makes it necessary for a temporary employee to fill in as a snow plow driver for Highway Superintendent Tim Kilhart during his recuperation from surgery. Young explained that the form also discloses the father/son relationship; he also noted that this type of exemption is only available to employees of towns with a population of less than 5,000. This is being done only to meet a particular need and only if absolutely necessary. Lemon MOVED to declare the position of Highway Employee a special municipal employee, and to grant Bruce Kilhart a Chapter 268A:20D conflict-of-interest exemption. Arguimbau SECONDED. Motion carried by a vote of 2-0-0. Both Board members signed the form. Lemon MOVED to direct the Highway Superintendent to investigate the possible availability of one or both finalists for the most recent job opening in the department as temporary employees and grant permission to hire his father if, and only if, neither man is available. Arguimbau SECONDED. Motion carried by a vote of 2-0-0. 3. Chapter 44 Section 31 D Snow and Ice Deficit Authorization -- Young said that we are 80% expended on the snow and ice budget and recommended that the Board vote to authorize deficit snow-and-ice spending per MGL 44S:31D. He noted that there is a possibility that deficit spending will not be needed, but the Board's vote to authorize will allow it to happen if it becomes necessary. Lemon MOVED under MGL 44:31D we authorize the Highway Department to go into deficit spending for snow-and-ice if necessary. Arguimbau SECONDED. Motion carried by a vote of 2-0-0. 4. Selectboard Reports -- Postponed until the next meeting. 5. Coordinator Report -- Postponed until the next meeting. 6. Other Business -- None. V.
