Town of Warwick Selectboard March 22, 2010 Minutes Members present: Rick Abbott, Patricia Lemon, Nick Arguimbau (arrived at 6:06 pm) Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Dawn Magi, Jon Calcari, Paula Robinson (Athol Daily News) Call to Order Vice Chair Abbott called the meeting to order at 6:02 p.m. in the Warwick Free Public Library. Lemon added two items to the agenda, to be covered during Selectboard Reports. Minutes Lemon MOVED to approve the minutes of February 22, 2010 as presented. Abbott SECONDED. Motion carried by a vote of 2-0-0. Arguimbau arrived at 6:06 pm. A lengthy review of the minutes of the March 17th joint Selectboard and Planning Board ensued. Arguimbau MOVED to continue the approval process of the March 17, 2010 minutes until the next meeting. Lemon SECONDED. Motion carried by a vote of 3-0-0. Presentations/Discussions Technical Assistance of the FRCOG for Fiber to Home Feasibility Study -- Young said that this process will not cost the Town any money. Abbott MOVED that the Town join the Town of Colrain's request to FRCOG for technical assistance for a fiber to home feasibility study, and send a letter requesting the technical assistance. Lemon SECONDED. Motion carried by a vote of 3-0-0. Request PVRS accept MSBA buy-out of WCS Outstanding Bonds-- Young explained that Warwick owes $41,228.00 due by June, 2010. This buy-out will not only wipe out all future debt, but will also result in $11,000.00 being returned to the Town. Lemon MOVED that the Selectboard, on behalf of the Town of Warwick, request that the Pioneer Valley Regional School District accept MSBA (Massachusetts School Building Authority) buy-out of Warwick Community School's outstanding bonds. Abbott SECONDED. Motion carried by a vote of 3-0-0. 3. Appointment of Alternate Representative to the Franklin County Solid Waste Management District - Young said that Julie Hubbard is familiar with environmental compliance, and would attend meetings if the Warwick's representative was unable to attend. Abbott MOVED to appoint Julie Hubbard as Warwick's alternate representative to the Franklin County Solid Waste Management District. Lemon SECONDED. Motion carried by a vote of 3-0-0. 4. Annual Town Meeting Warrant -- Young noted that the warrant can be re-opened and closed again if necessary, and that the Board can place something on the warrant up until the posting date. Lemon MOVED that the Annual Town Meeting warrant be opened effective March 23 and closed April 5. Abbott SECONDED. Motion carried by a vote of 3-0-0. 5. Review Annual Town Meeting Warrant -- Young presented draft copies of the ATM warrant to the Board, and reviewed it article by article. 6. Selectboard Reports -- Lemon requested that the Selectboard's meetings be moved back to the Town Hall, preferably in the Board's Room, beginning with the next meeting. Lemon MOVED that the Selectboard meet in Town Hall beginning with the April 5 meeting. Abbott SECONDED. Motion carried by a vote of 3-0-0. Lemon said she had spoken with the man from Creative Designs in Keene, who had made the Welcome to Warwick sign. He probably has scraps of lexan for the two pendant signs, which may cost the Town nothing, but would not cost more than $100.00. Young said that the funds could come from the Town Hall account, if necessary. Lemon noted that the Franklin County Tech School is lowering the fourth quarter assessment for Warwick. She also spoke about a meeting being held in Brattleboro on April 14th, called by the NRC (Nuclear regulatory Commission). Arguimbau reported that he had attended a conference at Holy Cross in Worcester on March 20th regarding municipal issues, including the new ethics laws. He said that the state is capable of issuing civil penalties of $10,000.00 for violations of the State Ethics Act. Arguimbau MOVED the Board request all Town employees take the State ethics exam online as soon as possible to avoid the Ethics Commission telling them they are no longer qualified to hold their municipal positions. Abbott SECONDED. Motion carried by a vote of 3-0-0. Arguimbau also issued an apology to Tim Kilhart and the Town for having let things get out of hand at the February 22 meeting, and for any misunderstandings of comments made by the public during that meeting. He said that the perceived discrepancies were initially misinterpreted, and that there is no real need for further investigation. Lemon reminded him that other board members could also have noticed and corrected the misconceptions. Lemon commented on the joint Selectboard and Planning Board meeting of March 17th, noting it was one of the best meetings she had ever attended and that she is proud to live in a town whose residents work together, offering constructive observations, rather than indulging in ad hominem attacks Arguimbau said that he will try to draft a resolution about the Supreme Court ruling on the First Amendment rights of corporations for the next meeting. 7. Town Coordinator Report-- Before Young began his report, Lemon praised him for his efforts in getting people to work on committees. Young noted that there may be a vacancy on the Board of Health, as Rita McConville has expressed her intention not to seek reelection. He said he has 4 possible recruits for the position, and that the operation of the Transfer Station is a priority. He said that Highway Superintendent Tim Kilhart will be attending a MEMA (Massachusetts Emergency Management Agency) as Warwick's representative. Young noted that the Cultural Council paperwork is now in order and all vendors have been paid. He also said that any Town official who wants an official Town email account may have one. Messages from a town Email account are saved indefinitely, and thus automatically meet the requirement that all official communications be preserved. Arguimbau MOVED to request all Town officials and employees obtain a Town email address and use it for all Town business. Lemon SECONDED. Motion carried by a vote of 3-0-0. 8. New and Other Business-- R. Calcari reminded the Board that a nomination for Animal Inspector must be voted upon, as the paperwork is due back to the Bureau of Animal Health by April 1st, prior to the next Board meeting. She explained the duties of Animal Inspector, which, by an ATM vote of May 1. 2000, is a responsibility of the Animal Control Officer. Lemon MOVED to nominate Rosa Calcari as Animal Inspector. Abbott SECONDED. Motion carried by a vote of 3-0-0. IV. Public Comment R. Calcari announced the Rabies Clinic will be held at the Warwick Fire Station on Saturday, April 3 from 12 pm - 2 pm.
