Call to Order Chair Magi called the meeting to order at 6:00 pm in Town Hall. Public Comment None. III. Minutes Arguimbau MOVED to approve the minutes of March 4, 2013 as printed. Magi SECONDED. Motion CARRIED 2-0-0. IV. Presentations and Discussions 1. Chapter 268 Section 20D--Young explained that Town Secretary Rosa Fratangelo Calcari had gone back to May of 2005 and identified the positions not previously declared as Special Municipal Employee. He said she also identified those with more than one position in Town that need a 20D exemption. Young recommended that the Board first declare the special municipal employee positions, and then grant the 20D ethics exemptions. Nomination of Inspector of Animals --Young explained that every year in March the Massachusetts Department of Agriculture sends papers asking that the Selectboard nominate an Inspector of Animals, who in turn is appointed by the State. He recommended the nomination of current Animal Inspector Rosa Fratangelo Calcari. Arguimbau MOVED to nominate Rosa Fratangelo Calcari as the Inspector of Animals. Magi SECONDED. Motion CARRIED 2-0-0. 3. May Pole --Clare Green said that she and Patricia Lemon wanted to have a May Pole event as one of the 250th Anniversary celebrations. She said that it would be held at the School on Sunday, April 28th at 1pm. Green noted that music teacher Kim Wallach will teach the students both the history of the May pole and the traditional dance. She said that Ted Cady has volunteered to plant a thirteen foot tree to be used for the May Pole, which will be planted three feet into the ground. She pointed out that the tree will be removed after the event and the hole covered up. Green was asking the Board to authorize the expense of $300.00 for a live band. Young noted that this would normally be brought before the 250th Anniversary Planning Committee, but as there were no scheduled meetings coming up, and sufficient funds are available, the Board was wiling to vote on the matter. Arguimbau MOVED to allocate $300.00 of 250th Anniversary Celebration funding for the band for the May Pole celebration. Magi SECONDED. Motion CARRIED 2-0-0. 4. Regional Radio Communication MOA --Young said that FRCOG has updated the Franklin County Emergency Communications System (FCECS) regional emergency radio inter-town agreement. He said that he had spoken with Emergency Management Director Jim Erviti, who recommended the Board sign the three-year Memo of Agreement (MOA). Young said that he also recommended signing the MOA, which would continue our participation in the system. Young said that Warwick is one of twenty six participating towns, and is referred to in the MOA as "User Agency". Arguimbau MOVED to approve the execution of an MOA between FRCOG, FCECS Oversight Committee and the Users. Magi SECONDED. Motion CARRIED 2-0-0. Magi signed as Board Chair. 5. Chapter 90 Paving Project--Young said this is the last part of a paving project and involves paving all of Hastings Heights Road and Athol Road on either side of its intersection with Hastings Heights Road, for a total of just over one mile. Young noted that some of the paving will be completed in FY 13, and the rest will be done during the 2013 construction season. Arguimbau MOVED to approve the Chapter 90 paving project for Hastings Heights Road and approximately one mile of Athol Road. Magi SECONDED. Motion CARRIED 2-0-0. Magi and Arguimbau signed the appropriate documents. 6. Buildings and Energy Committee--Janice Kurkoski explained that Bart Bales of Bales Energy Associates had completed a framing statement for Town/District cooperation for the Warwick Community School. This is the final framing statement for the proposed energy betterments at the School. The District has an agreement with the Town that has been in place for fifty years; according to the agreement the Town is responsible for all capital improvements. While the Buildings and Energy (B&E) Committee wanted the Town to be reimbursed for the betterments out of the operating savings, the District's stand would prevent this. Young suggested that a review of practices and the definition of capital improvements may clarify some issues. Kurkoski said that the statement has not yet been presented to the School. Young noted that cost savings would be realized from the first year after the energy betterments are put in place. Kurkoski said that she would like someone from the School to attend the B&E meetings. The discussion had to be interrupted for the posted National Grid Pole Hearing. 7. National Grid Pole Hearing --Young said that the hearing was legally advertised and the abutters were notified. He said that the closest abutter, Michael Humphries, wanted the wood if any tree cutting is necessary. Richard Nalewski of National Grid petitioned the Selectboard for a guiding pole across from pole #22 on Athol Road. He explained that the arborist for National Grid wanted the existing guide wires out of the dead trees and onto a new pole. He noted that no tree trimming should be required for this job. He said that he had spoken with Highway Superintendent Kilhart and confirmed that the new pole would be in the public way. Arguimbau MOVED to approve the placement of a new guying pole on Athol Road across from Pole #22. Magi SECONDED. Motion CARRIED 2-0-0. 8. Buildings and Energy Committee--Discussions on the WCS Framing Statement and proposed energy betterments resumed. Steve Kurkoski pointed out the opportunity for insulation to be installed during the replacement of the failed roof shingles. He said that once the roof replacement begins, some options for energy betterments will be lost if they are not done at that time. J. Kurkoski said that she wanted to see the Town paid back out of the energy savings as has been done in Gill. She noted that energy costs at WCS are 50% higher per square foot than the average of the other schools in the district, and that B&E encourages betterments to fix this. Young explained that even if Warwick pays and is paid back by the energy savings, per the District agreement we are responsible for 10% of the District's operating cost. A lengthy discussion of school budgets, Town Meeting votes, and other matters related to the matter ensued. J. Kurkoski said that B&E wanted the Finance Committee to review the framing statement and give its input and then present the statement to other towns. S. Kurkoski suggested that the B&E, Selectboard and Finance Committee sign off on the statement before bringing it to the other towns' Buildings and Energy Committees. B& E wants to meet with the Firemen's Association about the plans for the Public safety Building. J. Kurkoski said that B&E has been provided with some good sketches of the plans, and wants to be sure that the building is built better than code, to maximize energy efficiency. J. Kurkoski also pointed out that the Highway Department's equipment shed is not at all energy efficient and fuel costs are still too high. She compared the shed to a glass building from an energy efficiency standpoint. It was agreed that insulation should be investigated and the best type of insulation identified. S. Kurkoski mentioned the Governor's 20/20 greenhouse gas initiative, whereby a pledge is made to reduce the greenhouse gases 20% by 2020 and 80% by 2050. He expressed concern for the potential costs of retrofitting town buildings to meet the requirements. Magi thanked the B&E members for all their hard work and said that they didn't receive enough appreciation for all that they do. 9. FRCOG and Franklin Regional Retirement System--Young clarified the FRCOG and FRRS matter from the last meeting. He said that it is the intent of FRCOG to get legislation which would allow them to participate in the State Retirement system rather than the regional one. FRCOG Executive Director Linda Dunleavy will ask member towns for letters of support once the bill, sponsored by Representative Kulick, is assigned a number. 10. Proposed By-Law Changes--Young said that there are two proposed By-Law revisions submitted by Police Chief Shoemaker, and a proposed new By-Law, all of which are currently under review by Town Counsel. One change involves adopting Mass General Law regarding the appointment of police officers, the other would make open container prohibitions more enforceable by making violations arrest able. The new by-law would give the Highway Superintendent the authority to close roads for mud conditions and grant authority to the Selectboard to make exceptions provided the road user is responsible for damage to the road. 11. 25 Winchester Road--Young said that he had referred two complaints about the conditions of rental units at 25 Winchester Road to the Board of Health. The building is owned by absentee landlord who resides in the eastern part of the state. Young suggested the possibility of putting the property into receivership if the landlord remains uncooperative. 12. 2012 Audit Management Letter--Young gave the Board members bound copies of Scanlon's final FY 12 audit and management letter. He characterized this as a very good result, with seven recommendations and no findings. 13. Solar Farm By-Law--Arguimbau said that the ZBA wanted guidelines in advance of receiving any proposals, and that his recommendation was for the screening of facilities. He noted that the project may be dropped due to the inability to build in Warwick due to the lack of capacity of built distribution facility to take power from a development of much size. 14. Selectboard Reports--There were no reports given at this meeting. 15. Coordinator Report--Young said that he had nothing to add to his written report. The Board had no questions for him. 16. New and Other Business-- Young said that free cash had been certified at $135,147.00. He said that the Solid Waste Enterprise Fund was certified at $3,763.00 and the Broadband Enterprise Fund was certified at $6,922.00. V.
