Town of Warwick Selectboard October 1, 2012 Minutes Members present: Dawn Magi, Patricia Lemon, Nick Arguimbau Others present: Town Coordinator David Young, Town Secretary Rosa Fratangelo Calcari, Warwick Police Officers John Stewart and Rob Mallette, Jon Calcari, Jared Robinson (Athol Daily News) I. Call to Order Chair Magi called the meeting to order at 6:00 pm in Town Hall. Public Comment None. Minutes Lemon MOVED to accept the corrected minutes of the September 17, 2012 meeting as printed. Arguimbau SECONDED. Motion CARRIED 3-0-0. IV. Presentations and Discussions 1. Update on Proposed Broadband Contract Renewals--Young said that he was still waiting to receive the proposed contracts. He noted that sometime in October it will be one year that we have been waiting for these contracts. 2. Update on WCS Sprinkler Code Compliance Work-- Young said that the specialized items are being built, and will be installed upon arrival. After installation is completed, an inspection will be conducted. Young said that he believed all would be accomplished within the 60-day time frame of the Deputy Fire Marshal's order. Update on CDBG Program Income Management -- Young said that the Department of Housing and Community Development (DHCD) had told Greenfield that because it is a mini-entitlement community, it may not "partner" with other communities. Greenfield will meet with the state in an effort to sort everything out, but pending a resolution on the matter, Warwick is left in limbo. Young said that he is willing to meet with Greenfield and DHCD. He recommended waiting to see if things can be straightened out, and noted that the alternative is to seek other options. Young also said that, because these mortgages are the Town's assets, that he was in favor of getting all mortgages transferred to the Town of Warwick so as to no longer be in the name of the Housing Authority. 4. Update on Gravel Bank-- Young said that he and Arguimbau still need to conduct a site visit. He said that Donny Matthews gave him some history on the gravel bank. Matthews told Young that removal began twenty years ago because the State requires there be a flat spot to dump brush, stumps, and the like. Young noted that a previous Selectboard vote had prohibited the removal of this material from Town, and said that this condition has been upheld. 5. Update on Wood Pile at the Dump--Young said that the wood pile did not sell, so he planned to re-advertise. He said that he will ask the Transfer Station Commissioners to subsidize trucking if it becomes necessary. He said that the wood could be sold at a loss. He pointed out that for safety and liability reasons, any cutting must be done by a licensed contractor with liability insurance, and not by individual residents. Chapter 90 Reimbursement Forms--Each Board member signed all the necessary forms to obtain Chapter 90 reimbursement for two projects. A $67,000.00 reimbursement was for culvert replacement and paving; an $18,000.00 reimbursement was for drainage work on Hastings Heights Road Preliminary Discussion of a Town Ordinance with regard to Sex Offenders--Magi inquired if any town has drafted such an ordinance. Lemon replied that Lynn has put an ordinance in place, and another town on the North Shore is attempting to do so. Lemon said that the two issues she wanted to address are what constitutes proper notification, and whether or not there should be restrictions on where a sex offender can reside. Warwick Police Officer Rob Mallette explained that there are three levels designated for sex offenders. Level 1 is not public information, while Levels 2 and 3 are. He noted that while the total number of sex offenders living in a town is public information, postings are done only for Level 3. The discussion of a possible ordinance was put forth to protect the children, and to establish a restricted zone so that sex offenders may not live within a specific distance of the school. Lemon said that she wanted the townspeople to be aware of the discussion so as to obtain input. Arguimbau and Young preferred a low-key approach, rather than an actual hearing. Arguimbau also pointed out that any discussion was for a general sex offender group as a whole, not any particular individual. Mallette noted that right now there is nothing to preclude a sex offender from moving in right next to the school. Exclusion of permitted residence within a specific location or area requires the passage of an ordinance which gives the police something to enforce. Magi wanted to research any state and federal legislation on the matter; Young and Arguimbau stressed looking into ordinances in other small towns. Both Magi and Lemon will research and bring their findings to a future meeting. Selectboard Reports-- Magi reported that the 250th Anniversary parade held in Bernardston on September 22nd was very well attended. The Selectboard rode in the parade in a wagon pulled by a team of horses belonging to Ken Hubbard Jr. Coordinator Report--Young spoke about the medals to commemorate the Town's 250th anniversary. He said that Gregori Brodski has been working on a design and that he wants to begin production soon, with a proposed goal of having them ready for celebratory events in February 2013. Young said that the estimated cost for 800 medals is $2,200.00. Dr. Brodski wanted the Town to give a medal to each resident. Possible fundraising to defray costs was briefly discussed. Young said that he will meet next week with Vanu Bose for possible help with the town's cell service issue. Young noted that Senator Rosenberg had met with a DCR liaison to the Senate in an effort to accelerate progress on the proposed Broadband contracts. Young said that he was contacted by DCR's consultant for some information, which he provided. 10. New and Other Business--Arguimbau said that FRCOG will bring a draft plan to the next Hazard Mitigation Committee meeting on Thursday, October 25th at 2 pm in Town Hall. Young invited the police officers in attendance to attend the meeting to help identify hazardous areas of town. Young explained that once there is a plan that is accepted by FEMA, then the Town will be eligible to apply for grants to mitigate the identified hazards.
